These Terms & Conditions (“Terms”) govern your access to and use of the HYG2.io website, communications, consultations, and services. By using our website or engaging HYG2.io for services, you agree to these Terms where applicable. Specific client engagements may also be governed by a proposal, statement of work, order form, service agreement, or other written agreement.

About HYG2.io

HYG2.io provides business growth, operations, technology, automation, artificial intelligence, customer relationship management (CRM), communications, marketing-support, lead-management, and consulting solutions.

Specific services, deliverables, implementation schedules, fees, payment terms, service levels, and client responsibilities may be established in a separate written agreement. If a separate written agreement conflicts with these website Terms, the separate written agreement will control for that engagement to the extent of the conflict.

Website Use

You may use the HYG2.io website for lawful business and informational purposes. You agree not to misuse the website, attempt unauthorized access to systems or data, interfere with website operation, introduce malicious code, scrape or exploit protected content in violation of law or applicable rights, or use the website to engage in unlawful, fraudulent, or abusive activity.

HYG2.io may modify, restrict, suspend, or discontinue website features when reasonably necessary

Consultations, Assessments, and Information

Information provided through the HYG2.io website, forms, surveys, business assessments, consultations, or other communications is intended for general business and service-evaluation purposes. Unless expressly agreed in writing, it does not constitute legal, tax, accounting, investment, or other regulated professional advice.

Business recommendations may depend on information supplied by the client or prospect. You are responsible for providing accurate and complete information when decisions or implementations depend on that information.

Services and Client Responsibilities

Clients are responsible for timely access, approvals, information, content, credentials, permissions, and other cooperation reasonably required to perform agreed services. Clients are also responsible for reviewing and approving business-specific content, offers, claims, communications, and configurations before deployment when approval is required.

Clients remain responsible for their own compliance with laws, regulations, industry requirements, contractual obligations, and third-party platform policies applicable to their business and use of HYG2.io deliverables.

No Guaranteed Business Results

Business growth, marketing, sales, automation, artificial intelligence, operational, and consulting services involve factors outside HYG2.io's control. Unless expressly guaranteed in a signed written agreement, HYG2.io does not guarantee any specific revenue, profit, lead volume, conversion rate, ranking, cost savings, customer acquisition result, or other business outcome.

Examples, projections, case studies, estimates, or potential outcomes are illustrative and are not guarantees of future performance.

Third-Party Platforms and Services

HYG2.io services may use or integrate with third-party software, communications providers, CRM systems, payment processors, artificial intelligence services, hosting providers, advertising platforms, analytics services, and other technologies.

Third-party availability, pricing, policies, functionality, outages, approvals, account restrictions, and changes are outside HYG2.io's control. Your use of third-party services may be subject to the provider's own terms and privacy policies.

Artificial Intelligence and Automation

HYG2.io may use artificial intelligence and automated systems to assist with communications, lead management, scheduling, business analysis, content, customer support, workflow automation, and other operational functions.

AI-generated or automated outputs may contain errors or require human review. Clients are responsible for reviewing material business decisions, regulated communications, and other high-impact outputs before relying on them where appropriate.

Intellectual Property

Unless otherwise agreed in writing, HYG2.io retains all rights in its pre-existing and independently developed methodologies, systems, processes, templates, frameworks, workflows, prompts, know-how, branding, software configurations, documentation, and other intellectual property.

Ownership or licensing rights for client-specific deliverables may be addressed in the applicable proposal, statement of work, or service agreement. No HYG2.io intellectual property is transferred except as expressly stated in writing.

Payments and Fees

Fees, billing schedules, deposits, recurring charges, cancellation terms, refunds, and payment obligations for paid services will be stated in the applicable checkout, invoice, proposal, order form, subscription terms, or service agreement.

You agree to provide accurate billing information and to pay authorized charges according to the terms presented for the applicable service. Nothing in these website Terms creates a recurring payment obligation unless you separately authorize one.

SMS Messaging Terms

Program Description: Individuals who provide appropriate consent may receive text messages from HYG2.io concerning inquiries, requested services, consultations, appointments, service updates, customer support, follow-up communications, and, where separately authorized, marketing or promotional offers.

Consent: Consent to receive marketing text messages is voluntary and is not a condition of purchasing goods or services from HYG2.io.

Message Frequency: Message frequency varies based on your interactions with HYG2.io, the services requested, and the communication preferences you select.

Message and Data Rates: Message and data rates may apply. Your wireless carrier's messaging and data terms apply.

Opt-Out: You may cancel SMS communications at any time by replying STOP. You may receive a final confirmation message acknowledging your opt-out. After that, you will no longer receive messages covered by that subscription unless you subsequently opt in again.

Carrier Disclaimer: Wireless carriers are not liable for delayed or undelivered messages.

Rejoining: If you previously opted out and later wish to receive messages again, you may opt in again through an applicable HYG2.io signup or consent process.

Privacy: SMS communications are also governed by the HYG2.io Privacy Policy. SMS opt-in data and consent are handled as described in that policy.

Email and Electronic Communications

By submitting an inquiry or otherwise communicating electronically with HYG2.io, you consent to receiving electronic communications reasonably necessary to respond to your request or provide requested services. Marketing email communications will include applicable unsubscribe mechanisms where required.

Privacy

Our collection and use of personal information is described in the HYG2.io Privacy Policy. The Privacy Policy should be read together with these Terms.

Confidentiality

Where HYG2.io receives non-public business information in connection with a client engagement, confidentiality obligations may be established in the applicable service agreement, nondisclosure agreement, or other written terms.

Nothing in these website Terms requires either party to disclose confidential or proprietary information beyond what is reasonably necessary for an inquiry or agreed engagement.

Disclaimers

To the fullest extent permitted by applicable law, the HYG2.io website and general informational materials are provided on an “as is” and “as available” basis. HYG2.io does not warrant that the website will always be uninterrupted, error-free, or free from all harmful components.Nothing in this section limits any warranty or obligation that cannot lawfully be excluded or any express commitment contained in a signed client agreement.

Limitation of Liability

To the fullest extent permitted by applicable law, HYG2.io will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from use of the public website or free informational materials.

Any liability limitations applicable to paid client services should be stated in the governing service agreement. Nothing in these Terms excludes liability that cannot lawfully be excluded.

Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, or expenses arising from your unlawful misuse of the HYG2.io website, your violation of these Terms, or content or data you provide without the rights or authorization necessary for its intended use. Client-specific indemnification obligations, if any, should be addressed in the applicable service agreement.

Changes to These Terms

HYG2.io may update these Terms periodically to reflect changes in our website, services, communications practices, or legal requirements. Updated Terms will be posted with a revised “Last Updated” date. Material changes will apply prospectively to the extent required by law or an existing written agreement.

Governing Law

These Terms are governed by applicable United States law and, to the extent permitted, the laws of the State of Georgia, without regard to conflict-of-law principles. Any mandatory rights or remedies provided by applicable law remain unaffected.

Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
